Article 1 - Preamble
1.1 - The Website www.lagrosseboutique.com is operated by Emeraude Corporation SARL.
Any Order validated by a Customer (as that term is defined below) on the Site "LaGrosseBoutique.com" implies prior acceptance of these terms.
1.2 - Identification and purpose of the society
Emeraude Corporation Ltd. is a limited liability company under French law with a capital of 40,000 Euros which is headquartered in Zone Artisanale du Chemin Vert in Matignon 22550 Tel: 00.332.96.41.11.65 The purpose of the Emeraude Corporation is to compete directly or indirectly in commercial operations in the areas of electronic commerce and the Internet. The company Emeraude Corporation are located in Zone Artisanale du Chemin Vert 22550 Matignon
1.3 - Purpose of the conditions of sale - Reciprocal obligations
These terms are intended to define the rights and obligations of the parties in connection with the online sale of goods and services provided by LaGrosseBoutique.com to the Customer. These terms and conditions express the obligations, rights both of the Client and LaGrosseBoutique.com. In this sense, the Customer agrees to accept without reservation all the provisions set forth herein. LaGrosseBoutique.com mutually committed to respect its obligations under the present.
1.4 - Definitions

Customer Service is the main contact between the Client and LaGrosseBoutique.com. Customer Service is reachable from 9:00 to 7:00 p.m. Monday through Friday at 00.33.2.96.41.11.65. Customer may also contact Customer Service via the form on the internet site. Response time can not be guaranteed.
Article 2 - General
2.1 - Conclusion of contract - Acceptance of Terms
Insofar as the Customer Order Online Products and / or services offered on the Website LaGrosseBoutique.com, the electronic signature of the Client on the "Purchase Order" marks the conclusion of the contract between the Client and LaGrosseBoutique.com. Article 3 - Products
3.1 - Description and Information on Products

LaGrosseBoutique.com responsibility can not be held liable for incorrect information provided by the supplier (error in reference, feature, photography ...).
If the customer opts for a refund, LaGrosseBoutique.com will make every effort to reimburse the Client within 30 days from the date LaGrosseBoutique.com notifies the customer of the unavailability of the product. Exceeding this period for reasons beyond its control, LaGrosseBoutique.com can not be prosecuted by the Customer.
3.3 - Exceptions
Most products sold on the Site LaGrosseBoutique.com are stored in its warehouses. However, certain products are stored at the supplier. For these products, the availability period corresponds to the delivery of the Product from the Supplier's Warehouse to LaGrosseBoutique.com's Warehouse. In this case, the time of delivery to the customer is the time of availability at which to add the delivery time indicated on the Site. Similarly, the period of availability for withdrawal in Warehouse is the delivery time which must be added the usual time of order processing. These limits shall be from the date of confirmation of payment by LaGrosseBoutique.com.
Any failure to meet deadlines due to the lack of providers or carriers may in no case be the responsibility of LaGrosseBoutique.com.
Article 4 - Price
4.1 - Composition and validity
Prices of products sold on the site are indicated in Euros all taxes included excluding postage shipping, warranty, service schedules and are valid as they are present on the product information sheet. If the price of a product, is wrong on another site location (eg on homepage) or on the newsletter, it is the price indicated on the product sheet which is valid.
4.2 - Retail price

4.4 - Possible errors
All prices are subject to a typographical error. If an error should occur LaGrosseBoutique.com will contact the Customer to advise the mistake made by his office and remind him that the Order will be billed to the conditions corrected. However, in case of refusal conditions corrected, the client will be free to cancel the Order corrected without penalty.
Article 5 - Order
5.1 - Ability
Only persons legally capable of entering into contracts for goods and services offered on the Site, can order on the Site LaGrosseBoutique.com. When placing the Order, the Customer warrants that it has full legal capacity to adhere to these terms and conditions and enter into this contract. If upon confirmation of an Order the Customer becomes aware of the need to change some information, he may do so by contacting Customer Service via this form in its customer account within 24 hours so that it can best meet request.
LaGrosseBoutique.com can not be held liable for any input errors by the Customer or the consequences in terms of delay or error in delivery, including whether it is an Order placed by phone. Thus, if delivery can not take place because of a mistake by the customer, the return postage will be borne by the Customer. In this case, the Customer will refrain from any claims due to delivery.
5.3 - Confirmation and shipping mail
LaGrosseBoutique.com sends an email confirmation of the Order to the Customer to summarize the contractual information.
When the Customer's Order has been validated by the Sales Service of LaGrosseBoutique.com as payment validation procedures described in Section 6 below, the Client will receive another email informing them of the shipment date of its Order .
5.4 - Order process
The Orders are processed in the order in which they are actually received. LaGrosseBoutique.com undertakes to process all orders within the limits of available stocks. Deliveries are made subject to availability and in the order in which commands arrived and can be made globally or partially.

5.5 - Breach of Order

Article 6 - Payment Validation
6.1 - Purpose
The validation of the payment by the Services LaGrosseBoutique.com enables the dispatch of parcels to be at home or at the Customer Warehouse Removal chosen by the latter.
6.2 - Terms
In order to limit the risk of fraud and to protect the interests of its clients, LaGrosseBoutique.com is sometimes necessary to perform checks on the validity of payments made. At the end of this potential control:

6.3 - Deadlines
The Customer's billing usually occurs within 24 hours from the date of payment validation.
Article 7 - Payment
7.1 - Payment Security
For the security of transactions, LaGrosseBoutique.com, uses SIPS-ATOS if paid by credit card.
The bank reviews are encrypted on their own computer and then transmitted securely to SIPS-ATOS. This procedure is managed by SSL encryption technology, one of the most used and safest. Once payment is confirmed, the related data are destroyed and do not stay in SIPS-ATOS that is why LaGrosseBoutique.com request their data to its customers, for each new order.
7.2 - Payment
a) When the Customer chooses to have the goods delivered at home, the Customer has the possibility to pay in several ways:
(I) Settlement online by credit card (Blue Card, VISA, Eurocard / Mastercard) If payment online by card, Customer is required to provide the type of the Card, the card number, the expiration date and security code.
The Customer ensures:
- he is fully authorized to use that card
- That the card provides access to sufficient funds to cover all costs resulting from its Order.
(Ii) Payment on line with Paypal
7.3 - Failure to Pay
LaGrosseBoutique.com reserves the right to suspend or terminate the account of a Customer who contravene the provisions of these Terms of Use.
Any person whose account was suspended or terminated can not order on the Site without the prior authorization of services LaGrosseBoutique.com.
LaGrosseBoutique.com specifically reserves the right to refuse to deliver or process an Order from a Customer who has not fully paid a previous Order or has a litigation not resolved.
Article 8 - Removal
LaGrosseBoutique.com allows its customers to come and pick up their Order in one of its Warehouses.
8.1 - The confirmation of removal
Confirmation of removal (by appointment) is required for any removal to other warehouses.
The customer will be notified by mail of the availability of its order.
When the command is available for withdrawal, not removing the products within 10 days will void the Order if it has not yet been charged. If the Order has already been charged, it is canceled after a period of 20 days.
Any removal at the Warehouse without prior approval of a mail appointment informing the customer of the provision of the Order will result in risk ftro the Client of a long wait, the unavailability of the Products ordered and, in this case LaGrosseBoutique.com reserves the right to cancel the Order.
8.2 - Documents required for removal
During thepicking up of his command in the Warehouse Customer must present the following documents:
(I) E-mail Order confirmation
(Ii) If the invoice has been issued in the name of an individual:
- Proof of identity if his Order is less than 1500 Euros
- Two pieces of identification or proof of identity and proof of residence if his Order is more than 1500 Euros
(Iii) If the invoice has been issued in the name of a company:
- Extract Kbis under three months of this company
- The identity card of the manager of the company
8.3 - Proxy
If the person who comes for the withdrawal of the Order is not the client (whose name and address appear on the bill) that person will appear with the documents listed above as well as its own identity card and a proxy statement prepared and signed by the Customer (if an individual) or by the company manager (if a corporation).
Failure to comply with these provisions, LaGrosseBoutique.com reserves the right not to give the Order to Customer.
8.4 - Removal reserves
The day of the picking up, the Customer must sign a slip stating that the product is removed in perfect condition. The absence of reserves equivalent to irrevocable.
The removal of the product automatically generates the transfer of risk to the Client, which means that the handling, loading and transportation of the product is entirely his responsibility.
Article 9 - Shipping
9.1 - Delivery process
Except as otherwise provided in these Conditions of Sale, shipping costs are always charged to the Customer.
Products are necessarily delivered to the address given by the Customer when entering information in its Order. Therefore LaGrosseBoutique.com advises the Client to ensure the accuracy of the information he could provide for the delivery of his Order.
Delivery does not include installation or commissioning of the Product ordered, or the resumption of the old equipment. These actions can be specifically requested and are charged extra.
Our products are usually sent by post, however, certain types of product (large appliances, furniture, bedding ..) are not delivered by post but by specialized carriers.
9.2 - Delivery by Post
If Customer can not be present at the address indicated by him on the day of delivery, a Notice of Passage is filed in the mailbox of the Customer. It is then the Customer who has to withdraw his command at the Post Office from where he belongs within 10 days after the filing of the Notice.
After this period of 10 days, the Product is returned by the Post to LaGrosseBoutique.com.
If the client decides to ask for a new delivery, it must be paid before dispatch by contacting Customer Service.
If Customer wishes to cancel the Order, he may choose either a refund or to claim. If you choose a refund, LaGrosseBoutique.com will do its best to reimburse the Client within 30 days from the date of receipt of the returned product.
Exceeding this period of 30 days for reasons beyond its control, LaGrosseBoutique.com can not be sued by the Customer.
If Customer has entered an incorrect address in its Order, the Post will be unable to make delivery and the product will be automatically returned to LaGrosseBoutique.com.
9.3 - Delivery by Carrier
Some shipments by Carrier are subject to making appointments held between the Carrier and the Customer.
In this case, if the client can not be present on the day of delivery, he must choose a person
empowered to take delivery of the delivery and assume all responsibilities of the Customer.
This mode of delivery does not go upstairs merchandise.

In the event that the Carrier would suffer a significant delay beyond his control,
LaGrosseBoutique.com will attempt to provide a new delivery and costs
of this new delivery will be borne by LaGrosseBoutique.com.
In the case where the accessibility of the place of delivery (special delivery) chosen by the Customer will not allow the Carrier to make delivery of the Order by the main access to housing,
delivery can not take place but the shipping costs remain the responsibility of Customer. These
conditions can be eg: stairs too small or too narrow door or hallway too
narrow, no lift and high floor ... (See Section 9.5)
Upon delivery of the Product, the Customer must unpack the product in presence of Carrier. He must then verify the compliance of the Order delivered in the presence of Carrier before signing the Delivery Note.
In case of anomaly concerning the delivery, the Customer must indicate his reserves by handwriting
detailed observations , date, and signature on the delivery note. These anomalies can be:
1 - Product damaged: scratches, bumps, shocks ...
2 - non-conforming product in kind (error reference, color ...) or in quantity ...
In case of malfunction or non-conformity, the Customer must absolutely refuse the package and must promptly, on the day of delivery, provide its claims to LaGrosseBoutique.com Customer Service by registered letter to following address:

Any claim made beyond this period may be rejected without recourse for the Customer. The absence of complaints, the non-issuance of reserves by the Customer means that the product delivered is deemed satisfactory and may not be subject to any subsequent dispute. For example, the Customer may not make reservations to LaGrosseBoutique.com after the departure of the carrier, even if the package has not been opened in the presence of the carrier.
9.4 - Delivery time
Deliveries are handled by different carriers, specialized according to the nature of the product object of the Order.
Delivery times vary depending indicative of Carrier and are indicated on the sheet product.
To follow the progress of the delivery of their Order, the Customer receives an email at the time of shipment of the Product ("Product leaving our warehouse").
The terms mentioned in the sheet product is indicative and LaGrosseBoutique.com can not be held responsible for any consequences of late delivery.
Failure to receive a package in the indicative time, Customer may contact Customer Service to determine the cause of the delay, LaGrosseBoutique.com will then make an inquiry into the product flow from the carrier concerned.
Carrier sets itself the length of the investigation of loss. For example, a product supplied by Coliposte and not delivered to the Client will be investigated within a period of 20 days from the date of initiation by LaGrosseBoutique.com.
The initiation takes place in 24 business hours following notification by the Customer to LaGrosseBoutique.com of non receipt of the Order together with the documents necessary that LaGrosseBoutique. com is likely to ask the customer to initiate this investigation . If, during the period of investigation, the product is found, it is delivered to Customer.
If the product is not found at the end of the investigation and only on this condition, LaGrosseBoutique.com:
1 - send a replacement product at its expense if the product is still available.
2 - refund the price of the Order lost by the carrier or proposes a credit on the next purchase if the Products ordered are not available anymore.
In no case does LaGrosseBoutique.com will exchange or refund the product before the expiration of the period of investigation and the Customer may not return this fact against LaGrosseBoutique.com.
In case of non delivery of an order or part of the Order, the Customer shall have sixty (60) days from the date specified for delivery of Control to notify Customer Service. At the end of this period, no further claim by the Customer will be admissible, that is to say, any request for exchange, refund or claim will be rejected.
Article 10 - Right of withdrawal and right of return
10.1 - General
The Customer has a right of termination that he can exercise in informing the Customer Service.
In case of cancellation of order, the provisions of Article L 121-20 of the Consumer Code apply.
Pursuant to Article L 121-20 of the Consumer Code, the Customer has a right to return within 14 calendar days after receipt of an Order in the event of home delivery. The latter can thus obtain the right to return a product that does not suit them, without penalty.
The customer also has the right to return within 14 calendar days after taking charge of his command in case of withdrawal at one of our warehouses. The latter can thus obtain the right to return a product that does not suit him.
In case of exercising the right of return by the Customer and in accordance with the provisions of Article L. 121-20 of the Consumer Code, the costs of returning the order are charged to the customer.
Any request for return to LaGrosseBoutique.com beyond this period of 14 calendar days for any reason whatsoever will not be accepted.
For example, can not be taken into account the following reasons:
- Unable to contact Customer Service by phone (the Customer can send an email)
- Absence of Customer during the period of 14 calendar days after receipt of the Order by one third,
- Delivery of the Order on a vacation or secondary residence,

10.2 - How to return a Product

If the return is based on a change of mind, the customer must return to his post office and ship (at their expense) the Order to the address communicated to him by LaGrosseBoutique.com. The customer then has a period of 15 days for LaGrosseBoutique.com to receive the Product .
When the Order to be returned has been the subject of postal delivery and returns because of LaGrosseBoutique.com error or non-compliance of the Product, the Customer service sends the Customer a return slip Collissimo allowing him to ship the product without charge. The customer then has a period of 15 days for LaGrosseBoutique.com to receive the Product .
When the Order to be returned has been delivered by a carrier and that the return is because of LaGrosseBoutique.com error or non-compliance of the product, return of the product will be done at the expense of LaGrosseBoutique.com. To organize the return, the Customer must arrange an appointment with the Carrier, product must be taken by the carrier at the door bearing the case of a house or at the foot of the building if you live in an apartment.
During removal of goods in our warehouse, if returned, the customer must return by its own means the goods to the warehouse where the picking was carried out. The customer can not demand the removal of the product at home by LaGrosseBoutique.com.
The product must always be returned to LaGrosseBoutique.com in a state fit for resale, ie respecting the conditions of return set out below:
- In its exact state of origin
- Inside its packaging intact
- With all the accessories attached to it
- In perfect working condition
- Bearing no trace of use
- With his record
for Textiles:
- Product unworn
- Not dirty, unwashed
- Not ironed
- Folded in its original packaging.
- With the label product still hooked
Products must be sent with the return number provided by LaGrosseBoutique.com and sales invoice which has previously been printed on the Site.
The risks incurred in returning the product, whatever the cause lies with the Client. If the product is lost by the carrier during this shipment, the Customer shall be solely responsible and will not be reimbursed by LaGrosseBoutique.com.
In case of exercising the right of return in accordance with the provisions hereof, the customer will either get a refund of a credit egal to the amount of the purchase.
If the Client choose a refund, LaGrosseBoutique.com will make every effort to reimburse the Client within 30 days from the date of receipt of the returned product. Exceeding this period for reasons beyond its control, LaGrosseBoutique.com can not be prosecuted by the Customer.
If the Customer is reimbursed by credit bank, the speed with which the bank account is credited depends on the Client's credit card, in the case of a immediate debit card, the current account is credited within 3-8 days depending of the bank, in case of a deferred debit card, the credit will appear at the end of the month on credit card account and not on the current account. If repayment is longer, the Customer must himself contact his bank.
If the product fails to return to LaGrosseBoutique.com in the terms and conditions provided in this Article 10, the Customer can neither be reimbursed nor get a credit. In this case, if a customer wishes to again get the Product, it must be requested by the contact form or phone to LaGrosseBoutique.com which will send as soon as possible the Product. The return postage will be borne by the Customer and payable in advance by credit card.
Article 11 - Products Warranties
11.1 - General
Guarantees related to products sold are clearly detailed on their description. To obtain guarantee of Products, Customer must keep the invoice of the Product.
There are 2 types of guarantees:
manufacturers warranties, which are automatically included for the purchase of the Product
the optional coverage, which can be subscribed by the Customer with a specialized company and through LaGrosseBoutique.com with an additional cost.
The nature of these guarantees varies, they can cover:
- The cost of parts
- The cost of labor
- The cost of sending a technician at the customer
11.2 - Guarantees within 14 days
If the failure or non-functioning occurs within 14 calendar days after receipt of the Product by Customer, Customer must contact Customer Service LaGrosseBoutique.com which will indicate the procedure for its return.
No returns will be accepted without prior approval of Customer Service LaGrosseBoutique.com. This agreement is evidenced by the issuance to Customer of a return number and in accordance with the procedures and provisions of Article 10.2 above.
No product whose operation would prove to be defective after the expiry of 14 calendar days after receipt of the Product by the Customer will be supported by LaGrosseBoutique.com
11.3 Manufacturers Guarantees
If failure occurs beyond the period of 14 calendar days from the date of receipt of product and within the manufacturer warranty contained in the sheet product, the Customer must apply directly for After Sales Service. The Customer may in this case call the Customer Service LaGrosseBoutique.com making its best efforts to provide the details of after sales service.
LaGrosseBoutique.com would in no way be held liable for the actions and decisions of the manufacturer's service facility. For example, LaGrosseBoutique.com can not handle the return of a product that the manufacturer's service facility refused to take responsibility for whatever reason: shock during shipping, misuse of the product, etc..
11.4 - Warning
Products whose failure would result from negligence, abuse or inappropriate use, compared to the instructions for installation, use and operation of the Product, will loose all warranty.
